Freehold Enfranchisement (Houses)

Freehold Enfranchisement
(Houses)
In certain cases, qualifying single tenants of houses are entitled to enfranchise under the 1967 Leasehold Reform Act which confers on tenants of leasehold houses the right to acquire the freehold interest on fair terms.
The qualifications and basis of valuation of these types of claims can be complex to assess depending on a series of financial tests and limits, in some cases based on historic Rateable Values and complex qualification formulae.

First step in enfranchising your house
The first step in enfranchising your house is to instruct a specialist surveyor/valuer and solicitor who have expert knowledge in this field. The basis of eligibility is as follows:
- The house must have been owned for at least 2 years
- The house must be reasonably deemed a house (and there is a world of complex precedent Tribunal decisions surrounding this question!)
- It must be a long lease granted for a term of at least 21 years
Beyond that, the basis of valuation needs to be carefully considered.
Our surveyors have extensive experience and expert knowledge of the 1967 Act Valuations and are able to guide you through the whole process of valuing buying the freehold interest, providing expert evidence at Tribunal where necessary.
